City survival basics

  1. Try not to create preconditions for detention:

- if it is possible to refuse a night walk around the city-refuse without hesitation;

- if you still need to go, do not drink too much alcohol;

- if you have drunk a lot, do not take money and valuables with you;

- always have a personal passport or a document replacing it (military ID, officer's certificate, etc.);

- don't look confused, it's suspicious;

- never tell the police that you are in a hurry and do not show signs of impatience. The person who is in a hurry – a potential source of funds as it may give money to his soon released, while the man, thinking how to kill time and are even ready to go to office and sit there for two hours, because to do so is nothing – no interest;

- in any case, do not carry anything illegal with you! Especially in the outer pockets – they are searched first. If you wear it, think in advance how and what to hide so that it is "extremely difficult" to find it.

  1. If a meeting with a police officer occurred, then you, being a "law-abiding citizen" – show documents, explain where and where you are going, do not interfere with the inspection of personal belongings.
  2. If you, despite everything, are put in the car and taken to the Department, do not prevent it, because it is useless.
  3. if you want to see the police officer's ID, state your request. Do not try to take this certificate into your own hands.
  4. Don't try to run away, because they may just shoot you.
  5. it is Not necessary to Express dissatisfaction in the police Department. This will only prolong your time behind bars.
  6. Cops are people too. Do not deceive them, in any case do not download the rights, do not try to run, throw away (give) criminal items, etc. Try to negotiate with them in a good way. Try at all costs, in any case, not to bring the matter to the Department. As soon as the Protocol is drawn up, the mechanical machine of legal record-keeping will start spinning and then you will not be able to avoid the court.
  7. If police officers start beating you on the street (pushing you into a car), do not hesitate to shout as loudly as possible to attract the attention of others. You may need their testimony in court.
  8. If you were beaten in the Department, it is useless to shout about "criminal cops" in the same Department from behind bars. More or less calmly wait until you are released. Remember: the officer on duty in the Department will always cover up the crime of the patrolman who beat you (robbed). Remember: the management of the police Department, whose employees beat you (robbed) will almost always hide the crimes of subordinates.
  9. while Sitting behind bars, you should not share your thoughts about going to court with police officers.
  10. If you want to go to court, the Prosecutor's office, be sure to remove the beatings in the emergency room, pass an alcohol test and be sure to take a certificate. After you have submitted an official application, write as many letters as possible to various authorities explaining your situation and indicating the place where the application was submitted. Do not hesitate to frequently inquire about the progress of the case where you have submitted your application.

  1. SURVIVAL IN PRISON

Before calling the Prosecutor's office

  1. Give up the idea that you will never be detained by law enforcement agencies, and you will never be accused of committing a criminal act.
  2. Put off all entertainment before you acquire the Criminal procedure code (CPC), the criminal code (CC), the basics of criminal law (Basics), the Rules for detention of investigative prisoners (Rules) and the Constitution of the Russian Federation. It is quite easy to purchase these documents by contacting the relevant departments of bookstores. Do not spare money for these purchases – in prison, you will understand that the money was not spent in vain. Buy books in those publications that immediately give article-by-article official comments.
  3. Study these documents, first of all the CPC, then the criminal code. Do not be afraid to find out that you have repeatedly committed criminal acts in your life.
  4. Don't expect to be arrested every minute, but calmly be ready for it.
  5. Read and understand the CPC and CC, you will feel confident and be reasonably careful.
  6. Quit Smoking.

Call to the Prosecutor's office

  1. when you Find a subpoena in your mailbox, don't panic. Don't rush to remember your questionable deeds.
  2. On the agenda do not pay attention. Consider that you did not receive it at all (according to the law, it is). This should be done in order not to give an advantage to the Prosecutor's office: leaving a summons in the mailbox, the Prosecutor's office humiliates you, because the summons must be handed in person, under the law, against a receipt. Don't let the Prosecutor's office be rude to you from the very beginning. Therefore, you can only get a summons from the courier personally – not from your neighbors, or in any other way.
  3. Do not show excessive optimism (he is stupid in this situation) and naive belief in your innocence (even if you are a hundred times innocent in fact), that is, in the sense that THEY will sort it out and let you go, and decide in advance with a lawyer in case of arrest. If not personally, then warn your friends that you have received a summons from the Prosecutor's office, and you may need the services of a lawyer.
  4. Be prepared for the fact that you can be taken away from work in handcuffs by very arrogant guys who came from the police. Or "take" on the street.
  5. In any case, don't feel guilty.
  6. Prepare things in case of arrest: hygiene items, a change of underwear, some food, pens, pencil and eraser, more paper.
  7. Do not carry documents, valuables, any business papers, or personal correspondence.
  8. If you received a summons from the courier and know exactly when you will go to the Prosecutor's office for going up there empty all pockets of everything. Especially carefully check whether you have laid out documents, take a toothbrush and toothpaste.
  9. Be prepared for the fact that you may not return from the interrogation – go to jail. Your family and subordinates should be ready for this, if you are a leader. Take special care of your subordinates: is there money in their account for their salaries, etc.
  10. take the criminal code and criminal procedure code with You, if you have them.
  11. Don't panic.

First interview

  1. Enter the door of the investigator's office with confidence, there should be no place for guilt in your soul. Know that the investigator is no better or higher than you, including in the sense of cleanliness before the law.
  2. Remember, you have no friends in this house.
  3. In any case, never trust the investigator. Never accept any of his suggestions.
  4. when you are told why you were called and warned about your responsibility, ask for an explanation of your rights. Do not take the investigator's word for it, and demand to see the texts of the criminal code and the criminal procedure code of all the articles specified in the forms that you are given to sign.
  5. Never sign anything without reading it. If you read it and don't agree with what you read, don't sign it until corrections are made.
  6. All the questions are answered in monosyllables: Yes, no. In any case, do not go into lengthy explanations, do not provide additions, explanations, descriptions of events. In case of any doubt say: "I don't know."
  7. Remember: everything you say can and most likely will be used against you – and this is not an empty phrase. Most often, in the prosecution, the investigator relies on the testimony of the first interrogation.
  8. Remember: in 99 cases out of 100, the indictment for the investigation and the basis for a guilty verdict of the court are the testimony of the accused himself.
  9. be prepared for the fact that from the first interrogation you will not come out as a witness, but as a suspect, and not home, but in a temporary detention center (IVS). But don't be afraid of it.
  10. Always keep in mind that the investigator is not smarter than you and is not more professional in conducting interrogations and investigations in General.
  11. If the investigator is nervous or starts yelling at you and scaring you – this is a sure sign that he has nothing on you.
  12. at the first shout and the first threats, immediately stop giving evidence and do not resume it until you apologize. If you were yelled at (or insulted in any other way) after that, shut up for good for this investigator.
  13. If you feel that the answer to the question will be against you, don't answer it. You have a legal right to do this, given by the Constitution: no one can be forced to show against themselves.
  14. Don't be afraid of the investigator. Never. Do not be afraid to anger or offend him: remember that he does not have any good feelings for you, and your fate does not depend on the disposition of the investigator to you.
  15. If you are hinted at or offered to directly pay off – do not ever agree: first, it may be a provocation (which is unlikely, in the vast majority of cases, investigators really want to get a bribe), and secondly, thereby you admit your guilt and now the investigation will be able to "drown" you at any time.
  16. if you are detained (i.e. taken into custody), immediately request a lawyer.

The first camera in the prison

  1. when you Cross the threshold of the camera, understand: you are now alone, there will be no help for you from anywhere, and now you only have to rely on yourself. It mobilizes.
  2. Don't be afraid of either the camera or the cellmates – both can be ominous at first glance.
  3. Do not believe that you will be called somewhere tomorrow or someone will come to inquire about you in the morning: for the next three days, you can only be given a small amount of tasteless food and answer all your questions in monosyllables: "we do not know Anything." This is done by the investigation specifically to break you. Be aware that the investigation is about you remember, and through the wardens, the inmates are carefully watching you all these days. And the wife is rushing around, trying to pass you food, clothing, medicine, but she is simply not allowed to see you and the transfer from her is deliberately not taken. On the outside, there is a stormy life associated with you, because chamber silence is deceptive.
  4. The cell did not spread the language of the business. Answer in the same monosyllabic way as in the first interview.
  5. Be prepared for provocations from both jailers and cellmates – they (one of them almost always) can be sent by the investigation.
  6. Be prepared for the fact that suddenly you may be transferred to a pre-trial detention center (remand center), that is, to a prison. The very fact of this is depressing, but it is much easier in prison than in the IVS. It's a paradox, but it's true.
  7. Give up (for a long time) sighs about delicious food – eat everything that is given, regardless of the appearance, taste, etc.
  8. Don't think about your family. You can't help them. Don't worry about them.
  9. Be calm. Anger, hatred, and worry take away your strength.
  10. Try to sleep at night and stay awake during the day.
  11. Take care of yourself and observe personal hygiene.
  12. Spend time primarily on rest: sleep off, read, write, play-everything that is possible.
  13. Do not support empty conversations, do not give in to the temptation to borrow something.
  14. Have the courage to quit Smoking, otherwise you risk sinking to the state of a person begging for a cigarette from anyone and for anything. After that, you will definitely lose your case.
  15. Understand: for many months you have started a completely new life for you, mostly independent of you.
  16. Withdraw into yourself. Do not engage in self-examination, self-abasement, or repentance, but in self-analysis. In no case do you enter into a state of guilt.
  17. Write a statement demanding a lawyer. In any case, do not agree to a lawyer offered by the investigator. Make a statement that you refuse to take part in any investigative actions without your lawyer.
  18. In the cell behave independently and still: all of you here in the same position.
  19. Study the code of criminal procedure and the criminal code, if you have them.

Interrogation as a suspect

  1. agree to be questioned only in the presence of your lawyer. This is provided for by law.
  2. Don't forget that you are not obliged to testify against himself.
  3. Demand compliance with all procedural rules. There are no details in this case.
  4. don't believe the investigator in anything: in 99 cases out of 100, he is bluffing. Do not rush to believe that your friends have made a reservation, but do not discard this option, be ready for it.
  5. your allies-time, the answer "I don't remember", faith in the family.
  6. Check the accuracy of all entries in the interrogation Protocol, filling in all columns, including the time and date of the interrogation.

First time in prison

  1. Understand that you have completely lost the status that you had when you were free: now you are treated as a complete nonentity by all the jailers – from the rank and file to the warden. Remember this and don't be offended.
  2. Prepare yourself for a dark, absolutely gnatosoma mind as prison cells and the jailers. Take a mattress, a pillow, a blanket, bed linen, a spoon, a mug – everything that is offered.
  3. Don't be afraid when you go into the cell: the feeling that you are in hell, in a criminal den will pass. Shaven, sinister people can make you like them after half an hour.
  4. your first cell in the prison is a quarantine. Here everything is common, do not be afraid to take anything from the table, no one will reproach you. There are no tricks among the prisoners. Here you will be explained the set of chamber rules. But don't forget: there may be decoys here, too.
  5. Do not be filled with boundless respect and trust for your cellmates: it is quite possible that you are the most educated, the most intelligent and the most powerful among them, and they are only portrayed as experienced.
  6. Try to find your place in the camera. Understand how you can be useful to others.
  7. Sleep whenever possible, as soon as you see the bunks free. Don't worry about things – they don't steal here.
  8. In any case do not go to prison slang – stay human here.
  9. Remember: you are not forgotten in the wild and they are trying to do everything to free you. It may be harder for them than it is for you.

Life in the camera

  1. in the cell, you need to have your own: a spoon, a mug, a bowl, soap, toothpaste and a brush, a washcloth, a towel, bed linen, flip-flops. From products: lard, onion, garlic, condensed milk. From medicines: your medicines; traditional: for coughs, colds, stomach and headaches; as many vitamins as possible, especially vitamin C. you Can have a boiler, TV. You need to have a pen, a notebook, chess (dominoes, checkers-optional), something educational.
  2. In prison you do not need anyone, therefore consider where you will put that kind of time.
  3. Going into the camera and say Hello, ask where you can drop the mattress. You can be checked by specifying a place next to the push. Smile and put the mattress anywhere, but not next to the toilet.
  4. wait Quietly – you will be told where and when you will sleep. The cells are full, so you'll have to take turns sleeping.
  5. when you are invited to talk in a corner of the camera very threatening people and offer to share or exchange things, do not agree to either, without even explaining the reasons: "Not want". And don't be afraid of these people – they are only menacing in appearance.
  6. remember: no one will take or take away any of your belongings (including transfers) without your consent: the right of ownership in the cell is sacred. Do not forget about this – do not touch someone else's without first asking permission.
  7. don't become dependent on anything or anyone: give up bad habits, especially bad ones: Smoking, for example. Smoking addiction is hardly the main cause of a person's fall in prison.
  8. take Good care of yourself: wash, wash your clothes, cut your hair, and so on as soon as possible.
  9. lead a rational lifestyle: if possible, eat a balanced diet (if you have any), regularly consume vitamins, and suppress the disease at the first malaise. Try to stick to the regime that is possible: it is desirable to sleep at night. Move as much as possible.
  10. remember that the camera is your home for a few months, or even years.
  11. therefore, settle down. However, try not to get used to either the cell or the people, so that the transfer to another cell (which is often practiced by jailers) does not become a tragedy for you.
  12. stay independent. If you think that you have found a person (two, three...) with whom it is easier for you to exist, unite with them. But don't be too quick about it.
  13. do not allow yourself to become a slave owner: you may be offered a servant-orderly. There are two ways to go down in prison: to become a "mistress" (a slave) or to become the owner of a "mistress".
  14. realize: you are caught in the millstones of the law enforcement system, they grind you not because of dislike for you personally, but because of their anti-human and human-destroying essence – this is what they are created for. In prison, you must understand this.
  15. remember: you are not forgotten in the wild. And if in the prison information vacuum you get the impression that you are buried alive, this is not true – they remember you and do everything for your release.
  16. do not close your mind to your business, do not focus on your current situation, drawing it as terrible, impossible, and so on.
  17. Remember that no matter what happens, even if you are condemned, life does not end there. And ahead of you are waiting for meetings with your wife, appeals, Amnesty.
  18. Remember: all the horrors that you drew about life in the "hut" (that is, in the main cell), there are actually, but not so terrible, because the degree of their "horror" depends on you.
  19. Taboos of chamber life that exist are more often humorous if you treat them calmly.
  20. Real chamber laws are simple: inviolability of personal property and non-resistance to personal will. These principles both protect you and are your enemies.
  21. Your main enemy in the cell: your weakness before temptations and your bad habits. Don't give in to new bad habits. One of them is to drink chifir.
  22. Never change anything (clothes, things, food...) with your cellmates.
  23. Never ask for anything from your cellmates.
  24. Never get involved in a" showdown " if you are not asked.
  25. do not raise any "revolts" against the chamber orders, no matter how wild they may seem to you, – live by yourself. The changes you want will come to you after a while, because others will understand from your example that you can still be a human being in prison.

The test of time

  1. The test of time – the most profound impact on you in prison.
  2. You think that everyone has forgotten you: both the "organs" and the family. Be sure that this is not the case. The prison atmosphere is deceptive, remember this, and if it doesn't calm you down, repeat it to yourself: "The investigation deliberately makes me feel that I have been forgotten by everyone."
  3. Earlier, you had to realize that your conclusion will be long. Take it for granted, because you can't change anything.
  4. Devote the "time of forgetfulness" to yourself. Look back at the past.
  5. Look to the future. Do it calmly: there is no hurry.
  6. Engage in self-education. It is quite possible that this period of quiet life is the only one you have. Use it.
  7. in no case do not focus on your business: the amount of information that you had, you have already processed for a long time, you have nothing new – wait for progress.

Fighting the system

  1. Remember: you must fight "justice", and not expect from it favors (they will not be). Therefore, study the Criminal procedure code very well and monitor its compliance with both the investigation and the jailers. Immediately write complaints to the Prosecutor, to the Department of justice, to deputies of all levels, to the Prosecutor General's office – as soon as you see any violation of the law by the investigation or prison. Keep a copy.
  2. Use every opportunity to get yourself released: write petitions to the investigation, the Prosecutor, complaints to the court as soon as there are reasons to do so.
  3. Don't be afraid of the System, don't be afraid of the consequences – resist. Only the struggle will support you, will not let you sink in body and soul.

Advice to relatives of the arrested person

  1. First of all, don't panic. And don't flatter yourself that IT will be sorted out and released soon – this is unlikely to happen.
  2. Accept the arrest as another, but not fatal, ordeal that has befallen you all.
  3. Do not seek an immediate date – these troubles are empty and nothing will give you or him, even if the date takes place.
  4. Begin immediately to prepare for my show. Here is what the transmission should be for the first time:

- toothbrush;

- toothpaste-1 tube;

- comb (not metal);

- disposable shaving machine (in the future we will keep in mind the man);

- towel (small);

- soap (a piece of toilet and household soap);

- bed linen: pillowcase, two sheets;

- flip-flops that can be wet;

- change of clothes;

- mug (liter and regular), bowl, spoon (not steel);

- boiler;

- thread, needles;

- sports suit;

- writing materials;

- some reading (what he likes);

- vitamins and" his " medications;

- some game (that likes).

Don't mess with food – it is absolutely not necessary in the first days. And all things and clothes pass old: prison is not a place for social gatherings.

  1. If the investigator allows you to prepare "your" for the stage in prison, then provide him with food:

- stew – 2 cans;

- sweetened condensed milk – 2 cans (milk cook);

- fat – 1 kg;

- onion-1 kg;

- garlic-0.3 kg;

- mayonnaise-1 jar (not glass);

- caramel – 1 kg;

- tea-1 pack.

Of course, it all depends on your capabilities, but keep in mind that a lot of food is never necessary to pass: it just does not reach your recipient – not because they will take it away (and this may be), but because he will initially behave like a normal person and distribute everything. You can't feed the whole prison anyway.

  1. in the future, try to collect small transfers, but more often. You must remember: in prison, the main thing is not how much is transmitted and what, but a sense of abandonment, to lead from the outside.
  2. Find a lawyer and arrange for the prisoner to meet with a lawyer as often as possible. Then you will know how he is and what he needs, and he will be calm. The lawyer in meetings with the client is not limited either by time or by the number of meetings. He is the salvation not only for those who are behind bars, but also for you.
